Terms and Conditions

These Terms & Conditions (“Terms”) apply to all orders, services, and communications with Mallory Embroidery Collective LLC (“Mallory Embroidery Collective,” “we,” “our,” or “us”). By placing an order or submitting an inquiry, you agree to the following terms.

Each proposal may include a quote, embroidery proof, and order or packing list. Together, these documents define the products, colors, sizes, quantities, pricing, embroidery design, dimensions, placement, thread treatment, delivery details, and other project requirements.
Before an invoice is issued, the customer must review and approve all applicable proposal documents in writing. Approval may be provided by signed proof or email using the approval language supplied with the proposal.
Customer approval confirms that the information shown is correct. Mallory Embroidery Collective is not responsible for errors in spelling, artwork, dimensions, placement, colors, quantities, product selections, or other details approved by the customer.
Changes requested after approval may require an updated proof, revised quote, additional charges, revised product availability, or an adjusted production and delivery schedule. If a change affects pricing or project requirements, the updated documents must be approved before invoicing or production continues.
The most recently issued revision of each quote, proof, or order document supersedes earlier versions.

Customer-supplied artwork must be provided in a usable format. While we take care to prepare artwork for embroidery, results may vary based on stitch limitations, garment type, and material.
Digitizing fees are non-refundable once work has begun. Digitized files remain the property of Mallory Embroidery Collective unless otherwise agreed upon in writing.

Due to the nature of embroidery, slight variations may occur in stitch density, thread color, placement, and finished appearance. These variations are considered acceptable and do not constitute defects.
Exact color matching cannot be guaranteed due to thread availability, material differences, and screen-to-thread translation.

We strongly recommend using garments sourced or approved by Mallory Embroidery Collective. When customer-supplied garments are used, we are not responsible for damage, defects, or inconsistencies caused by material quality, prior wear, or manufacturing issues.
In rare cases, garments may be damaged during the embroidery process. Our liability is limited to the replacement cost of the blank garment only.

An invoice will be issued after all applicable proposal documents have been approved. Approval does not authorize production. Payment is required in full before production begins unless otherwise agreed in writing.
Production begins only after payment requirements have been satisfied, all required approvals have been received, garments have been sourced or received, and any other stated production requirements have been completed. For customer-supplied apparel, production will begin only after full payment and receipt of all items.
Prices shown in quotes do not include applicable sales tax unless specifically stated. Tax will be calculated and added at invoicing where applicable.
Payment Methods
We accept approved electronic payment methods, including credit card and ACH where available. Available payment options will be provided with your invoice.

Estimated turnaround times are provided as a courtesy and are not guaranteed unless explicitly confirmed in writing.
Production timelines begin only after all of the following have been received and approved:
Final artwork and proof approval
Garments
Required payments
Turnaround time reflects production time only and does not include shipping transit time. Shipping timelines are subject to carrier conditions and are outside of our control.
Estimated turnaround times are based on current production capacity and availability. Turnaround may be extended due to equipment issues, scheduling constraints, or other circumstances outside our reasonable control. Clients will be notified of any material delay affecting production timelines.
Rush services, if available, may incur additional fees and must be confirmed in writing prior to production.

Due to the custom nature of embroidery, all sales are final once production has begun. Refunds or replacements will only be considered in cases of confirmed production error made by Mallory Embroidery Collective.
Cancellation Before Production
Orders canceled before production begins may still be subject to nonrefundable costs already incurred by Mallory Embroidery Collective. These costs may include digitizing, artwork preparation, special-order materials, shipping charges, and garments or products ordered from suppliers specifically for the customer’s project.Once garments, products, or materials have been ordered, the customer is responsible for any amounts that cannot be canceled, returned, or refunded by the supplier. Any eligible refund will be reduced by these costs and any applicable supplier restocking or return-shipping fees.
Cancellations requested after production has begun are not eligible for refund.

Customers confirm they have the legal right to use any logos, artwork, or designs submitted for production. Mallory Embroidery Collective assumes no responsibility for copyright or trademark violations related to customer-supplied materials.

Mallory Embroidery Collective LLC may photograph completed embroidery work for portfolio, website, social media, marketing, and sample purposes. Photos will focus on the finished embroidery work and completed product only.
We will avoid displaying personal names, faces, addresses, phone numbers, private order details, or other personal customer information.
Customer-provided logos, artwork, business names, or branded items may appear in photos of completed work. Any such use is for the purpose of showing examples of embroidery work completed by Mallory Embroidery Collective LLC and does not imply sponsorship, endorsement, partnership, or affiliation unless separately agreed in writing.
Customers may request that an order remain private before production is completed.

Mallory Embroidery Collective shall not be liable for indirect, incidental, or consequential damages arising from the use of our services. Our total liability is limited to the amount paid for the specific order in question.

These Terms & Conditions may be updated at any time without prior notice. The most current version will always be available on our website.
